Senator Feinstein blinks for now on Merced Ron Stork, Senior Policy Advocate
FOR and our allies continue to fight against passage of HR 2578 by the full House. The last two weeks we have also working to head-off a potential companion bill from being introduced in the US Senate that would weaken the National Wild & Scenic Rivers Act and devastate a protected section of the Wild & Scenic Merced River. Read Senator Feinstein's response to FOR saying that she is not carry legislation to drown the Merced River "at this time."
US District Court Denies US Army Bob Wright, Senior Counsel
Big News! The Court earlier today denied the Corps of Engineers motion to dismiss our case against the Corps, challenging the Corps' anti-vegetation rule for all the Nation's & California's levees. Read the Court's 31 page Order decided in our favor [230k pdf]. The Corps' procedural smokescreen has been blown away, & we will now get to the merits of the case. The Court also ordered the Corps to file its answer to our First Amended Complaint within 20 days. In our effort to stop the Corps in its War against Nature, to paraphrase Churchill, this is not the end, or even the beginning of the end. But it is, the end of the beginning. The Corps' skirmish line has been breached, & we are now prepared to join battle and seek to win on our upcoming motion for summary judgment against the Corps.
EBMUD pulls Pardee Dam Expansion from plans Ron Stork, Senior Policy Advocate
On Tuesday, April 24, the East Bay Municipal Utility voted 7–0 to adopt a revised Water Supply Master Plan that did not include building a new Pardee Dam. Friends of the River, the Foothill Conservancy, and the California Sportfishing Protection Alliance had successfully challenged the first Plan in court., which had featured the new dam that would have drowned the Electra and Middle Bar runs on the Mokelumne River.
Much of this section of the Mokelumne River has been recommended by the Bureau of Land Management for inclusion in the national wild & scenic river system and in recent years boating put-ins and takeouts have been constructed at the Highway 49 and Middle Bar bridges.
